Terms of Service
These Terms of Service (the Terms) govern your use of the Mr. Toots app (the App). The App is operated by Patrick Sieber (the Provider; full details in the Provider & Contact section at the end of these Terms). By using the App you agree to these Terms.
1. Subject and Description of Service
Mr. Toots is a companion app for digestion and gut health. The App offers in particular the following functions:
- Analysis of a stool photo you take, returning a Bristol stool type (1 to 7 or unsure), a Gut Score (0 to 100), stool colour and pattern hints
- Manual logging of entries, meal logging, streaks and a doctor report that summarises only your own entries
The App provides observations and insights to support self-awareness. It is not a medical device and does not provide diagnoses or treatment recommendations. Cautionary hints (for example regarding blood or black stool) are precautionary pointers, not a diagnosis. They do not replace medical assessment.
2. No Substitute for Medical Advice
The content of the App is provided for information purposes only. If you have health complaints, persistent abnormalities or warning signs, please consult a physician. Do not rely on the App in emergencies.
3. Requirements and Account
Use is based on anonymous Firebase authentication. No name, email address or registered account is required. You may optionally link an email address. You confirm that you have reached at least the minimum age required under the law of your place of residence to use such services.
4. Mr. Toots Plus Subscription
Additional features can be unlocked through the paid subscription Mr. Toots Plus. The subscription is managed via RevenueCat. Payment is processed exclusively by the Apple App Store or Google Play, not by the Provider. The Provider receives only the subscription status, never your payment or card data.
Term, price, renewal and cancellation are governed by the details shown in the respective app store at the time of purchase. You manage and cancel the subscription in the settings of your Apple or Google account.
5. Right of Withdrawal (FAGG)
As a consumer you may be entitled to statutory withdrawal rights for digital content and services under the Austrian Distance and Off-Premises Contracts Act (FAGG). Where the service is provided immediately with your express consent, the right of withdrawal may lapse early. Refunds for amounts paid via the app store are governed by the policies of Apple or Google.
6. Your Obligations
You undertake not to misuse the App, not to submit unlawful content and not to manipulate, decompile or disrupt the App. You are responsible for the accuracy of your manual entries.
7. Availability and Changes
The Provider strives for high availability but cannot guarantee uninterrupted access. The Provider may further develop, change or discontinue features of the App to the extent this is reasonable for you.
8. Liability
The Provider is liable without limitation for intent and gross negligence and for damage arising from injury to life, body or health. In the case of slight negligence, the Provider is liable only for breach of a material contractual obligation and limited to the foreseeable damage typical for the contract. Mandatory statutory liability provisions remain unaffected. No warranty is given for the completeness or accuracy of the observations provided by the App.
9. Intellectual Property
All rights in the App, its design and its content remain with the Provider or its licensors. You are granted a simple, non-transferable right to use the App within the scope of the contract.
10. Changes to These Terms
The Provider may amend these Terms to the extent this is objectively justified and reasonable for you. You will be informed of material changes in an appropriate manner.
11. Governing Law and Jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions (including the KSchG and FAGG) at the consumer's habitual residence remain unaffected and are not restricted by this choice of law.
12. Severability
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
